The Director of Open Government dismissed Complaint #OOG‑2019‑0008‑M, filed September 26, 2019, alleging that the Commission on Selection and Tenure of Administrative Law Judges (COST) violated the DC Open Meetings Act by failing to provide proper public notice for a July 13, 2016 meeting. The Office of Open Government determined that the alleged notice email was first discovered by the Complainant on September 9, 2019. However, since she had previously filed complaints regarding July 2016 meetings (including July 13), which were dismissed on January 12, February 16, May 29, and October 3, 2018, the Director concluded that the matter had already been addressed and would not be revisited. Additionally, the Director noted that the Complainant requested the Director “vacate all actions taken at the July 13 … meeting,” but under 3 DCMR § 10403.2 and OMA regulations, the Director lacks authority to rescind COST’s actions.
