OOG Comments on the D.C. Board of Elections Notice of Proposed Rulemaking

The D.C. Office of Open Government (OOG) provided comments on the District of Columbia Board of Elections (DCBOE) Notice of Proposed Rulemaking released on October 13, 2023. OOG commented on subsections 102.4 to 102.8, which cover DCBOE’s notice/agenda, closed-session, and minutes procedures. As currently written, OOG finds that these subsections do not comport with the Open Meetings Act in certain respects, specifically: (a) permissible reasons to close meetings, (b) the timing of notices of meetings, and (c) the timing of posting of minutes/draft minutes.
